Where is Kratom Legal?

Kratom legality is a question that concerns many. 

Users want kratom to remain legal because it helps them manage pain, stress, and anxiety, boost their mood and gain extra energy. According to testimonials and stories from users, kratom can be used instead of prescription drugs for numerous health conditions. Such as fibromyalgia, arthritis, back pain, depression, and even PTSD.

Federal agencies, on the other hand, want to ban it. They claim that kratom has no medical benefits and poses high health risks.

At the moment, kratom remains legal in certain locations. However, it’s outlawed in others and you can face serious consequences for disregarding that. There are also countries where kratom legality is unclear.

Therefore, knowing if kratom is legal or not in your geographic location is important to know before you purchase it. 

But, before we tackle this, let’s look at…

The History of Kratom Use and Legality

Relatively new to the western world, kratom was a traditional medicine in Southeast Asia for centuries. It was used as a stimulant and pain reliever, as well as for a number of conditions such as digestive disorders, intestinal parasites, and cough.

There were no rules or regulations about kratom. Peasants and workers could freely use it.

In the early 1800s, kratom was discovered by Dutch settlers. They brought kratom to Europe and started investigating it. Yet, it became popular among users only in the early 2000s.

The AKA (American Kratom Association) estimates that there are about 3-5 million kratom users in the United States. And, according to the data from 2016, kratom industry in the US was worth over a billion dollars.

Kratom Legality by Country and Continent

Kratom Legality: US

In late August 2016, the DEA (Drug Enforcement Agency) announced it’s intent to place kratom and its active components under Schedule I of the Controlled Substances Act. Their reason was kratom’s opioid-like properties and concern about public safety.

While the proposal received major backlash from the public and was withdrawn, the battle for kratom continues.

Kratom Bans in the US States

Currently, kratom is legal in most of America except for the following states:

  • Alabama
  • Arkansas
  • Indiana
  • Rhode Island (though Rhode Island may reverse the ban)
  • Vermont (though Vermont may reverse the ban)
  • Wisconsin (though Wisconsin may reverse the ban)

Kratom Bans in the US Cities and Counties

Kratom is also illegal in the following cities and counties:

  • San Diego in California
  • Monument Town in Colorado
  • Parker Town in Colorado
  • Sarasota County in Florida
  • Jerseyville in Illinois
  • Alton in Illinois
  • Edwardsville in Illinois
  • Alcorn County in Mississippi
  • Belmont County City in Mississippi
  • Blue Mountain City in Mississippi
  • Booneville City in Mississippi
  • Bruce City in Mississippi
  • Burnsville City in Mississippi
  • Caledonia City in Mississippi
  • Calhoun City in Mississippi
  • Calhoun County in Mississippi

In the remaining locations, it is legal to grow, possess, and use kratom. You also do not need a prescription to buy it. 

Regulating Kratom

The FDA does not regulate it at this time. There are no regulations on the federal level that would endure the purity and quality of kratom products. Therefore, kratom cannot be sold or marketed to treat any sort of condition or disease. That means that kratom is legal as long as vendors do not sell it labeled as a dietary supplement.

To counter that and ensure buyer safety, individual states are taking the initiative to regulate sales, manufacturing, and labeling of kratom products using the Kratom Consumer Protection Act. A few states in the US regulate kratom and more consider regulating it.

Kratom Legality
Latest Update: November 2020

Kratom Legality: Canada

Kratom legality in Canada is a grey area, similarly to how it is in the United States. There is also an ongoing debate about whether the government should implement a kratom ban.

According to CFIA (Canadian Food Inspection Agency) and Health Canada, kratom is illegal if one sells or possesses it with an intent to ingest.

Yet, kratom powder and capsules are available for sale in Canada. As long as it’s not meant for ingestion, kratom remains legal.

Kratom Legality: Europe

While the European Union has no borders and has a unified currency, each country has its own legislation.

Thus, kratom legality by country will vary.

As of 2016, it is illegal to import, export, or sell kratom in the United Kingdom. There is a UK based kratom company that claims that kratom is 100% legal in the UK. Nonetheless, the UK Psychoactive Substances Act that came into effect in May 2016, does include in the list of outlawed substances that produce psychoactive effects.

In 2017, Ireland also enlisted kratom as a Schedule I illegal drug.

Kratom also remains a controlled or illegal substance in Latvia, Lithuania, Poland, Romania, Russia, Sweden, and Turkey.

Since 2016, kratom has been listed among major drugs in Italy. It is illegal to possess, sell, or import it there.

In Denmark and Finland, kratom is a controlled substance, yet one can purchase it with a valid doctor’s prescription.

Germany remains a grey area for kratom users. It is not an illegal substance, but it can only be bought or sold as a herb that isn’t supposed to be ingested. Therefore, vendors sell it as an ethnobotanical sample or sometimes even as paint. 

Hungary has a similar situation. Kratom is illegal for human consumption, yet it’s possible to buy and sell it as a botanical sample for analytic purposes.

In the rest of the European countries, kratom is currently legal.

Kratom Legality: Australia and New Zealand

In 2003, Australia banned kratom as a narcotic substance due to concerns about potential abuse. However, no actual instances of kratom abuse have ever happened there.

Since 2009 kratom and its active ingredients are illegal to grow, buy, or sell in New Zealand without a medical prescription. If you do have one, you can use kratom in New Zealand without problems.

Kratom Legality: Asia

Ironically, the very region that kratom is indigenous to, does not allow its free use. At least not everywhere. 

ASEAN

ASEAN, the Association of Southeast Asian Nations, refers to kratom as a drug. No traditional medicines or dietary supplements in these countries can contain kratom or its derivatives. Thus, it is illegal to use, buy, or sell kratom there. Countries that are a part of the ASEAN are:

  • Brunei
  • Cambodia
  • Indonesia
  • Laos
  • Malaysia
  • Myanmar
  • Philippines
  • Singapore
  • Thailand
  • Vietnam

Yet, you’ll notice that some of the countries on this list, for example, Indonesia and Malaysia, are where kratom is currently grown and produced.

Despite the blanket regulation, in several of these locations kratom legality remains a grey area. It’s neither legal or illegal, having no rules regulating it within the country. Or, it is illegal and heavily punishable, yet allowed to be grown, harvested, and exported (without using it, of course).

This makes it dangerous to purchase kratom directly from these countries. No laws or regulations means that there is no guarantee that their kratom is safe, lab-tested, and contaminant-free. We highly advise anyone against purchasing directly from Asian countries and instead choose US-based vendors who test kratom in US-based labs to ensure that it is contaminant and adulterant free. If you travel to any of these countries and are unclear about the status of kratom there, it’s best not to put kratom in your luggage. Southeast Asian countries normally have strict drug laws and heavy punishment for breaking them if you get caught.

Thailand

In addition to that, Thailand legalized kratom for medicinal use in December 2018. Nevertheless, it remains not entirely “legal” as Thai police keep repeatedly seizing kratom possession. Moreover, in August 2019, Thai Prime Minister critically referred to kratom starting that it may be legalized if proven useful.

Since then, Thailand has been inching toward legalizing kratom. In summer 2020, the country decided to decriminalise the use of kratom in certain parts of the country, aiming to monitor the effects of legalizing kratom.

Korea, Japan, China, and India

South Korea also prohibits the use of kratom. You risk fines or jail time if you choose to import or export it.

Kratom is illegal in Japan.

Its status is unclear in China and there are no reliable sources to clarify that. However, according to our sources various vendors on TaoBao, the Chinese equivalent of Amazon, were shut down after listing it for sale. Also, considering China’s policy on opioids (which are illegal), we wouldn’t risk using or importing kratom into China.

In India kratom is currently legal, though be careful purchasing it there. There is a tree of the Mitragyna family that grows in India. While it has similar properties they aren’t the same as those of kratom. Indian vendors label it as Indian Kratom which is much cheaper. Yet, users have complained about it not being nearly as effective and causing nausea.

Kratom Legality: South America

The only official reports on kratom legality are available on Brazil where kratom is legal.

Is kratom legal in other locations around South America?

Currently, there is no reliable information available in other South American countries. But, users have reported having no problems traveling into and around South America with kratom.

They do, however, advise against traveling back to the USA from countries such as Colombia. They mention that border officials can mistake kratom for coca leaves and may cause issues.

Traveling with Kratom

If you intend to travel with kratom, be sure you know the latest information on the legislation of kratom in your destination. Is kratom legal there? Then, most likely you will be fine because, in most locations around the world, kratom is currently legal.

Nonetheless, there are countries where you will face a fine or other punishment if you act against the law. If you are an active-duty military member, you cannot take kratom with you either. The US military prohibits kratom. 

Keep in mind that there are locations that are still unfamiliar with kratom. As a result, they may not have any rules or regulations about it at all.

Meanwhile, other countries have kratom legality in the unclear, grey area.

If that is the case and you can’t find a definite answer to whether you can enter the specific country with kratom, it may be safer to leave your kratom at home. Doing so will ensure that you don’t get into any legal problems.

It will also prevent the reputation of kratom from being tarnished even further. Any negative incident anywhere in the world can be used by federal agencies as a reason for the kratom ban.

    FYI: Since 2016 kratom has become an illegal substance also in Italy, legally compared with “major” drugs, so no importing, selling or possession of it in any form.

      It’s all the pressure from China’s CCP that has all these other countries shying away from Kratom. Italy relies on a massive amount of export trade to China so they bend their knee and do as the superpower says.

    I live in Oregon, right on the border of Idaho. It is readily available in both these states. But I am a huge advocate for Kratom and MJ. I believe kratom can be used responsibly without any issues such as addiction. I suffer from Aspergers (a form of autism) Depression and PTSD as well as ADHD and several anxiety issues. all of which interfere with my daily living. I cannot tell you how impressed I am with kratom and how well it works for me. Since I cannot use marijuana at this time I have to turned to kratom for help with these symptoms. If the FDA, DEA or any government agency for that matter makes this illegal I will be unable to buy kratom, thus opening a world of suffering and pain for me. If there is any way I can help fight to keep kratom legal, please let me know.

    Is Kratom legal in France ? I will be travelling from Oregon to France next week and want to either bring my Kratom or purchase Kratom in Paris. I cannot find any definitive answer on the Internet.

      There isn’t actually a definite answer. According to information available to us, kratom isn’t mentioned in the legislation of France. See more here.
      However, Europe, in general, is a lot less familiar with kratom that the US. Most people have never heard of it even in countries where it’s banned.

      From the information that is available to us, it does not appear that kratom is a controlled substance in Hungary. Though it would be much safer to review the laws on controlled substances in the national language before you do anything. There may have been updates that we are not aware of.
      Frequently, if there is a ban on kratom, it applies to the two primary alkaloids in kratom – mitragynine and 7-hydroxymitragynine. If neither kratom nor these two alkaloids are mentioned in the list of controlled substances in Hungary, they chances are that they are legal in any pure form.
      If kratom in Hungary remains legal, it does not seem like it is popular. So, to ensure that you get access to pure high-quality kratom, it’s always best to opt for kratom powder. Kratom capsules are convenient, but it’s easy to modify their content and add other substances. Especially if there are no laws regulating kratom.
      If you would like to use capsules regardless, it is relatively easy to make kratom capsules at home.

          Yes, indeed, Hungarian is complicated. That is the case with most European countries and their legislation.
          There is this page that talks about controlled substances in Hungary. It is an EU page, so we aren’t sure if it’s the latest and the most complete version.
          There is a shop that sells kratom in Hungary, they have a page in English. So, perhaps, you could get in touch with them and clarify the situation.
          They have three physical locations in Hungary.

      Are you interested in kratom farmers directly in regions where they produce kratom? if so, we would honestly advise you against doing so and choosing vendors who are based in your country.
      The reason for that is very simple – they have already done the hard work for you. While you indeed can get some of the best kratom directly from the source, there are many dishonest people who are simply trying to monetize off of the popularity of kratom.
      We are not saying that all of them are like that. However, you risk losing money, wasting a ton of your time, and getting a fake product trying to find an honest and reputable vendor. Especially if you have personally not been in Indonesia or dealt business with Indonesian locals on a personal basis. If you look for user experience in Reddit subgroups when people have been tricked into sending over thousands of dollars and not getting anything or getting a subpar or contaminated product. We’re not trying to insult or discredit locals in Indonesia, but we’re about providing the best possible information on kratom and making sure it stays legal. Things just work differently there, the legalities, work ethic, and hygiene standards are different.
      Kratom vendors (note that we do not say that all are equal; you still need to choose wisely) usually have done the vetting for you. They have found reliable farmers and, if they care about their customers, they lab test their products upon importing them. That rules out any potential contamination and adulteration. You importing directly from Indonesia would not guarantee that the kratom powder is pure. If you import from the source, it may technically cost less but you risk getting a fake or contaminated product. If you test it by yourself, then you may be spending a lot more than simply buying from a trusted and reputable vendor.
      Yes, you could technically establish your own relationship with a kratom farmer, but we personally believe that is far more convenient to just find a god vendor in yoru country.

      To be honest, we do not have any definite information on Saudi Arabia. There is a Middle Eastern e-commerce platform that sells kava and books on kratom, but no actual kratom products.
      It is an Islamic country and Islam is against any drugs that are non-medically prescribed. Yes, we know, kratom isn’t actually a drug, but, sadly, that’s how many authorities refer to it.
      So, considering this specific situation and the lack of conclusive information, we personally would not risk it.
      We’re sorry that we do not have a more specific answer to that.

        Hi, I will be traveling to Croatia in the next few days. I’ve heard it is safe to bring Kratom there but I may have to travel through Bosnia and Montenegro at some point. Have you heard anything about people traveling with Kratom in those countries? Thank you

          Kratom is not as popular in Europe it is in America. In many European countries, kratom is an unknown substance. Therefore, there likely won’t be any laws regarding it and officials at the border control may not know what it is. Bosnia and Montenegro are some of these countries.

      First of all, vacationing in Bora Bora sounds amazing. Hope you have a great time.
      We understand your concern. If kratom makes you feel better, you’d like that during your vacation. However, you wouldn’t want your vacation ruined either.
      Unfortunately, we cannot locate any definite information on kratom on Bora Bora and chances are that there aren’t any kratom specific laws.
      Assuming is never a good approach, especially when it comes to kratom. While it is not illegal in France and French laws apply in Bora Bora, Bora Bora does have it’s own regulations too. The regulations on possession of soft drugs, especially cannabis, seem to be rather stringent and since French law applies, you do not get a right to immediate access to a lawyer and can be detained for up to 3 days for questioning. Yes, we know, kratom isn’t a drug but, unfortunately, we need to view it in terms of authorities here.
      Perhaps you could consult the kratom community in Reddit and see if anyone has had any experience with kratom in Bora Bora or you could ask the hotel that you’re staying at or the Bora Bora Tourist Office? If you do choose to contact them, we advise you to do so from an e-mail address that you didn’t use for registration and one that does not have your passport name. For security reasons. It may also be a good idea to consult multiple places to see what the most common answer is.

      Hi Adam,
      Kratom hasn’t been included in any controlled substance lists, so it is legal in Spain. The Canary Islands are a part of Spain, so the Spanish law applies.
      Keep in mind though that kratom isn’t well-known in Spain, so it’s likely that the local police and authorities may not know about it either.

      In Hong Kong, kratom appears to be legal. However, in France, there no mention of it in the legislation. By technical definition, it would be legal, but we would still advise you to approach it with caution.

      That’s a tricky question actually. While most kratom comes from Indonesia and many have reported having traveled there, local authorities are debating whether they should ban in and list as a Schedule I drug. So, it would be good to check back shortly before your trip.

    Hello, I am traveling to Norway from Oregon where Kratom is legal. I have a 2 hour layover in England. Is is legal to bring a small amount of kratom with me on my trip? (Finding discrepancies on if it’s legal in Norway or not or if it is if I’d have problems with it in a checked bag with my layover in London.

      To be honest, for your safety, it may not be the best option to bring kratom on your trip. Though not as popular in Europe, kratom is illegal in the UK and is only legal with a medical prescription in Norway.
      It is not 100% certain that you will have issues, but there is also no guarantee that you won’t.

      No definite information on Tunisia is available to us. It is highly likely that kratom there is not known.
      Also, keep in mind that Tunisia is primarily a Muslim country and Islam is rather strict in regards to drugs. While kratom isn’t a drug, it could be perceived as one by someone who’snot familiar with it.
      We’d advise you to execute caution.

      Hello Franzi, to our knowledge kratom is not stated in the Maldives controlled substances act. However, the country has a very strict anti-drug policy and laws. Certain substances like alcohol are illegal to import and prescription drugs require a doctor’s notice. In severe cases, people disobeying the local law risk lifetime imprisonment. Since kratom is frequently listed as a psychoactive, it can potentially cause problems.

      According to the information available to us, kratom appears to not be illegal in India. This is, however, not a 100% guarantee that it is legal. Also, screening procedures may vary depending on which airport you use and officials may not be familiar with it.

      In addition to that, keep in mind that there is an Indian variety of Mitragyna, that people in India call Indian kratom. It is much cheaper but also not nearly as effective as the actual Mitragyna speciosa.

      Keep in mind that due to the stereotypes about westerners, there is lots of scamming going on in India (in all aspects, not just kratom), especially with first-time visitors. Therefore, we advise you against buying kratom in India. Even if the source claims it’s the real thing, most likely it’s not. Real kratom is expensive according to Indian standards, and importing, paying fees, etc. is not worth it to sell it in India.

          If you have never been to India before, we warn you to be cautious with pretty much everything – prices, haggling, transport, special offers, pickpocketing, and that does not only refer to kratom. When it comes to kratom, it’s best not to buy it there. Without knowing the source, it’s unlikely that you will get a legitimate product for adequate prices. People who work in tourism are very experienced with foreigners and are able to tell who is inexperienced and easy to scam. We’re not a travel blog, but we advise you to read up on travel experiences in India so that you are prepared.

          And enjoy your trip. You must remain cautious at all times, but, in general, India is amazing!

      There is nothing on kratom in the Seychelles Drug Act. However, we would advise you against taking kratom with you due to a few reasons. Cannabis is an illegal substance in Seychelles. While kratom and cannabis are not even related, this could still raise suspicions to a person unfamiliar with kratom. Secondly, importing any plant products or edible fruits or vegetables requires permission from the Ministry of Natural Resources. More information here.

      It just seems that bringing kratom may cause you problems. We are really sorry that your wellbeing may be affected by that and we really hope that the international reputation of kratom improves with time.

    just a FYI on Kratom legality in Germany. It isn’t illegal to buy, sell, import, or use Kratom in general, you’re just not allowed to sell it as a drug that the buyer is supposed to ingest. Then it would be an unapproved medical drug and the sale would be illegal. It is usually sold as an ethnobotanical sample or even paint

      The legal situation of kratom in the UK is a bit tricky. While there are no laws specifically forbidding kratom consumption, it is illegal to import or sell it. So, those saying that it is 100% legal to use kratom in the UK are technically not incorrect. However, you’d need to break the law to use it if you choose to import it yourself or obtain it from someone who has broken the law if you buy from them.

      There will be plenty of Indonesian farmers claiming that they ship to the UK. However, it is not something we advise you to do. First of all, because you risk having legal problems. Secondly, many of these farmers are scammers or do not follow safety and hygiene practices that vendors in, for instance, the US, follow upon importing. We actually have a full post on the dangers of purchasing directly from Indonesia. Simply type “farmers Indonesia” in the search box.

      Other sources such as China, India and other Southeast Asian countries are also risky options for a multitude of reasons

      Hopefully, this changes in the future. It’s a pity that you are unable to access this beneficial herb in the UK. Hopefully, the ongoing research on kratom yields positive feedback that will help change the global opinion on the herb.

    Hi- I’m flying to Malta from the states with a layover in Turkey. It looks like kratom is illegal in turkey but legal in my final destination. If I put kratom in my checked bag will there be any issues in Turkey?

      Kratom is not legal in Turkey, and it appears to not be illegal in Malta, though that is not a guarantee that it is 100% OK to have it there. You may still be at risk of experiencing issues.

      When it comes to your overlay in Turkey, we would not risk. Checked-in luggage may still be scanned or otherwise checked, such as using sniffer dogs. Moreover, a few weeks ago, in mid-December, Istanbul airport seized a shipment of kratom going from Indonesia to US. The shipment was large, thus easier to detect; however, we personally would avoid traveling with kratom in this specific instance.

      Unfortunately, there is no information available on kratom legality in Diego Garcia.

      However, the island is internationally represented by the UK and it’s a British overseas territory. This would mean that the laws and regulations of the UK would apply, and, unfortunately, kratom is illegal in the UK.

      Moreover, if you are with the military, keep in mind that kratom is not approved for use by military members, meaning that it is best that you do not take it with you.
